On July 1, 2017, the long-awaited Prostitutes Protection Act came into force. Most people have heard or read about it, but only a few really know what it’s all about. We at Escort Munich have spared neither cost nor effort and have researched it. What falls under the Prostitutes Protection Act? What changes affect you as a customer? What changes for the Escort Lady and what for us as an Escort Agency?
Prostitution in Germany
Prostitution, the oldest profession in the world, has been a legal profession in Germany since 2001. Until this year, it was not considered a criminal offense, but an immorality. In restricted areas, e.g. Munich, it was and still is punishable (§ 184 f. StGB). The change in the laws was intended to shift from “protection from prostitution” to “protection in prostitution”, so that people who decide to work, e.g. in the Escort Business or in prostitution, have more rights and are also more publicly recognized.
In addition, the step towards legality is intended to curb pimping and human trafficking. Until 2017, it was legal in Germany to work as a Sex Worker, but there was no real set of rules until then. As in any other trade and as is usual in Germany, there have to be rules and regulations for everything. Anyone who runs a restaurant or a gaming hall also has to comply with applicable rules and laws.
What falls under the Prostitutes Protection Act?
Definition of terms:
Prostitution (sexual service) includes anyone who performs a sexual act on at least one person for payment or allows a sexual act on themselves for payment. This means that erotic massages, dominatrixes, tantra massages or allowing oneself to be sexually touched by a customer count as sexual services and acts.
Excluded are porn, peep shows, pure table dance performances, webcam offers and phone sex.
Prostitutes are persons who provide these services.
Persons operating the prostitution trade are persons who commercially offer services in connection with the provision of sexual services or provide rooms for this purpose, e.g.
operate a business (brothel, sauna club),
provide prostitution premises (caravan, motorhome),
carry out, offer or organize prostitution events (gangbang party),
operate a prostitution mediation (Escort Service Munich agency).
What changes for you as a customer when booking an Escort?
For you as a customer, actually nothing changes. Although the offer of Escort Munich companionships will certainly become smaller, the wheat is separated from the chaff. You will also be offered fewer services. For example, sex without a condom, oral/anal and vaginal intercourse may no longer be advertised and practiced, but otherwise not much changes.
What changes for the Escort Ladies?
Anyone who prostitutes themselves, works as an escort or masseuse or wants to offer other sexual services commercially must register with the responsible authority and be registered as a prostitute.
Persons over 21 years of age must renew the registration every two years, persons under 21 years of age even every year.

– health insurance
– counseling and assistance offers
– reachability in emergency situations
– tax obligations
– health counseling (every twelve months, under 21 years every six months)
– sexually transmitted diseases
– pregnancy
– drug abuse
Creation of a “Prostitute ID”, this contains:
– Name or stage name (alias name)
– Photograph
– Date and place of birth
– Nationality
– registered places of work
– Validity period (12 or 24 months)
– Place of issue
